The short version
- Wimsi Cove is for people aged 16 and over.
- Be kind. No bullying, hate, harassment, scams, or anything illegal or sexual involving anyone under 18.
- You own what you post. You give us permission to show it in Wimsi Cove so the app can work.
- We can remove content or accounts that break these rules, and you can report anything that worries you.
- Marketplace sales are between the buyer and the seller. Sellers are responsible for their items.
- You can stop using Wimsi Cove and delete your account at any time.

1. Who we are
Wimsi Cove is currently run by its founders, Declan Testo and Anna Stark, based in Scotland ("Wimsi Cove", "we", "us", "our"). We're in the process of setting up a limited company to run Wimsi Cove. When we do, we'll update these terms with the company's details, and the company will take over our rights and responsibilities under them.

2. About these terms
These terms apply when you use the Wimsi Cove app, the website at wimsicove.com, our waitlist, and any related features (together, the "Service"). By using the Service, you agree to these terms. If you don't agree, please don't use the Service.
Our Privacy Policy explains how we use your personal information. It isn't part of these terms, but please read it.
We may update these terms from time to time, for example when we add features or when the law changes. If a change is important, we'll tell you in the app or by email before it takes effect. If you keep using the Service after the change takes effect, the new terms will apply. If you don't agree with them, you can stop using the Service and delete your account.
3. The website and waitlist
Before the app launches, you can join our waitlist on wimsicove.com. Joining the waitlist is free and doesn't create an account, guarantee you a place, or guarantee that the app will launch on any particular date or with any particular feature. You can leave the waitlist at any time by emailing us or using the unsubscribe link in our emails.
Where we offer launch perks, such as a numbered "Founding Member" badge for early members, we'll explain how they work when the app launches. We may change or end a perk if we need to, and we'll apply perks fairly.
4. Who can use Wimsi Cove
You must be at least 16 years old to join the waitlist, create an account, or use the Service. By using the Service, you confirm that you are 16 or over. If we learn that someone under 16 is using the Service, we'll close their account and delete their information as described in our Privacy Policy.
You also must not use the Service if we have previously banned you, or if the law prevents you from using it.
5. Your account
- Give us accurate information when you sign up, and keep it up to date.
- Keep your login details private. You're responsible for what happens on your account, so tell us straight away if you think someone else has accessed it.
- One person, one personal account. Don't create accounts for other people, or create new accounts to get around a suspension or ban.
- Your username and profile must follow the community rules below. Don't pretend to be someone else, including another user, a public figure, a brand or Wimsi Cove.
6. Community rules
Wimsi Cove is meant to be a warm, welcoming place. When you use the Service, you must not post, share or do anything that:
- bullies, harasses, threatens, intimidates or targets anyone;
- promotes hatred or violence against people because of who they are, including their race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, disability or age;
- is sexually explicit or pornographic;
- sexualises, exploits or endangers anyone under 18 in any way. We report this to the authorities;
- encourages or glorifies suicide, self-harm or eating disorders;
- is illegal, or promotes or helps with illegal activity, including the sale of illegal or dangerous items;
- shares someone else's private or personal information without their permission (for example their address, phone number or private photos);
- is a scam, fraud, phishing attempt, or misleading or spam content, including fake giveaways, fake reviews and unwanted advertising;
- infringes someone else's copyright, trade mark or other rights, such as posting artwork, patterns or book text that you don't have permission to share;
- contains viruses or harmful code, or tries to hack, overload, disrupt or gain unauthorised access to the Service or other users' accounts;
- collects data from the Service using bots, scrapers or other automated tools without our written permission; or
- tries to get around our safety features, such as message requests, blocking, or restrictions on photos in private messages.
We may publish more detailed community guidelines. If we do, they'll form part of these rules.
7. Your content
You own your content
"Your content" means anything you post or upload, such as posts, comments, photos, reviews, messages and your profile. You keep ownership of your content.
Permission you give us
So that we can run the Service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, display, adapt (for example resize or format), and share your content within the Service, and to show it to the people you've chosen to share it with. This licence lets us run, improve and promote the Service. If we want to feature your content outside the Service, for example on our Instagram, we'll ask you first.
This licence ends when you delete the content or your account, except where: someone else has already reshared or replied to it within the Service; we need to keep it for a short period in backups; or we need to keep it to meet a legal obligation, deal with a report, or protect people's safety.
Your responsibility
You're responsible for your content. You confirm that you have the right to post it and that it follows these terms and the law. We don't check content before it's posted, and we don't endorse what users post.
Feedback
If you send us ideas or suggestions about the Service, we may use them without owing you anything.
8. Safety, reporting and moderation
- Reporting: you can report posts, comments, messages, profiles, Marketplace listings and users using the report tools in the app, or by emailing admin@wimsicove.com. You can also block other users.
- What we may do: if we reasonably believe something breaks these terms or the law, or puts someone at risk, we may remove or restrict content, limit features, or suspend or close an account. Where appropriate, we'll tell you what we've done and why.
- Serious harm: we may preserve information and share it with the police or other authorities where the law requires it, or where we believe someone is at risk of serious harm.
- Complaints and appeals: if you think we've made the wrong decision about your content or account, or you want to complain about how we've handled a report or about our safety measures, email us at admin@wimsicove.com with the subject "Appeal" or "Complaint". We'll review it and reply as soon as we reasonably can.
If you're worried that someone is in immediate danger, please contact the emergency services first.
9. Messages and Cove Circles
Wimsi Cove lets you send private messages and join Cove Circles, which are private group chats. To help keep people safe:
- messages from people you don't follow go to your Message Requests, and you choose whether to accept them;
- photos can't be sent in one-to-one private messages;
- the community rules apply in private messages and Cove Circles too, and messages can be reported.
Cove Circle owners can add and remove members and customise their Circle, but they must follow these terms when doing so.
10. The Marketplace
The Marketplace lets independent sellers list handmade and hobby items. When you buy from a seller, your contract is with that seller, not with Wimsi Cove. We aren't the seller, and we don't make, own, store or ship the items.
If you sell
- You're responsible for your listings, items, prices, delivery, returns and customer service.
- Your listings must be accurate, and your items must be legal, safe and yours to sell. Don't sell counterfeit items or items that copy someone else's designs or characters without permission.
- If you sell as a business, you must follow consumer law, including giving buyers the information and cancellation rights they're entitled to, and handling your own tax.
If you buy
Your legal rights as a consumer are against the seller. If something goes wrong, contact the seller first. You can also report a seller or listing to us and we'll look into it.
When Marketplace payments become available, extra Marketplace terms (and the terms of our payment provider) will apply. We'll show you those before you buy or sell.
11. Our content and brand
The Service, including its design, code, logos and our own text and graphics, belongs to us or our licensors. "Wimsi Cove" and our logos are our brand. You may not copy or use them without our written permission, except to refer to the Service in a fair and accurate way.
Book covers, game images and other materials shown in our catalogues belong to their owners. We show them to help you identify books, games and hobbies, and their owners don't endorse us.
12. Other services and links
The Service may link to or work with other websites and services, such as Discord servers, online shops, or app stores. We don't control them and we aren't responsible for their content or how they use your information. Their own terms and privacy policies apply.
13. Changes to the service
Wimsi Cove is a new service, and we're always improving it. We may add, change or remove features, and the Service may sometimes be unavailable, for example during maintenance or because of technical problems. We'll try to tell you in advance about big changes that affect you. If we decide to close the Service entirely, we'll give you reasonable notice and a chance to download your information where we can.
14. Ending your use
You can stop using the Service and delete your account at any time in the app's settings, or by emailing us.
We may suspend or close your account if you seriously or repeatedly break these terms, if we have to by law, or if we reasonably believe your account puts other people, us, or the Service at risk. Unless there's a good reason not to (for example, safety, or a legal reason), we'll tell you and explain how to appeal.
Any parts of these terms that are meant to continue after your account closes, such as sections 7, 15 and 17, will continue to apply.
15. Our responsibility to you
The Service is for your personal, non-commercial use, apart from selling in the Marketplace in line with section 10.
- What we're responsible for: we'll provide the Service with reasonable care and skill. If we fail to follow these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our failure or our negligence. Loss or damage is foreseeable if it's obvious it would happen, or if both you and we knew it might happen when you started using the Service.
- What we're not responsible for: we aren't responsible for what other users post, say or sell; for problems caused by things outside our reasonable control; or for any loss of business, profit or opportunity.
- What we never exclude: nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded by law. Nothing in these terms affects your legal rights as a consumer.
16. App stores
If you download Wimsi Cove from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google aren't responsible for the app or its content, and aren't required to provide support for it. Their own terms also apply to your use of their stores. If you downloaded the app from the Apple App Store, Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.
17. Law and disputes
These terms are governed by the law of Scotland. If you have a dispute with us, please contact us first so we can try to sort it out. If we can't, you can bring legal proceedings in the courts of Scotland. If you live in England and Wales or Northern Ireland, you can also bring proceedings in your local courts, and you keep the protection of any consumer laws that apply where you live.
If a court decides that part of these terms can't be enforced, the rest will still apply. If we don't enforce a right straight away, we can still enforce it later. You can't transfer your rights under these terms to anyone else. We may transfer ours to another organisation, for example if Wimsi Cove is bought by another company, but this won't affect your rights.
